1. Acceptance of Terms

By accessing or using BuzzFlix, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), as well as our Privacy Policy. If you do not agree to these Terms, you must not access or use our services. These Terms constitute a legally binding agreement between you and BuzzFlix, Inc. ("we," "us," or "our"). We reserve the right to update these Terms at any time without notice to you. Your continued use of BuzzFlix following any changes indicates your acceptance of such changes.

2. Description of Service

BuzzFlix is an innovative, AI-powered content creation platform designed for producing high-quality short-form videos. Our service utilizes advanced artificial intelligence and machine learning algorithms to assist users in creating engaging, trending, and personalized video content. Features may include, but are not limited to, automated video editing, content suggestion algorithms, trend analysis, and seamless publishing integrations. While we strive to provide a comprehensive and reliable service, we do not guarantee that our services will always be available, uninterrupted, timely, secure, or error-free.

3. User Accounts and Registration

• To access certain features of BuzzFlix, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
• We reserve the right to disable any user account, at any time, if in our sole discretion we believe you have failed to comply with these Terms or if we suspect any fraudulent, abusive, or illegal activity.
• You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.

4. Content Creation and Ownership

• Users retain ownership of the original content they create using BuzzFlix. However, by using our services to create, modify, or publish content, you grant BuzzFlix a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service and BuzzFlix's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service.
• You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to grant the rights and licenses set forth in these Terms.
• While we do not claim ownership of your content, you acknowledge that the AI-generated elements, templates, or enhancements provided by our service may be used by other users and may be subject to our intellectual property rights.
• You understand and agree that you are solely responsible for your content and the consequences of posting or publishing it. BuzzFlix does not endorse any content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with user content.

5. Prohibited Content and Conduct

Users may not create, upload, or share content that:

5.1 Illegal or Infringing Content

• Violates any applicable local, state, national, or international law or regulation
• Infringes upon or violates the intellectual property rights, privacy rights, publicity rights, or other legal rights of any third party
• Contains any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable

5.2 Harmful or Fraudulent Activities

• Promotes or encourages illegal activities
• Impersonates any person or entity or misrepresents your affiliation with a person or entity
• Involves commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, barter, advertising, or pyramid schemes
• Contains viruses, malware, or other malicious code

5.3 Platform Abuse

• Interferes with, disrupts, or creates an undue burden on the Service or the networks or services connected to the Service
• Attempts to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service
• Uses any automated system, including without limitation "robots," "spiders," "offline readers," etc., to access the Service

6. Payment and Subscriptions

• Certain features of BuzzFlix may require a paid subscription. By subscribing to a paid plan, you agree to pay the fees associated with the selected plan.
• Subscription fees are billed in advance on a recurring basis, depending on the billing cycle you choose (e.g., monthly, annually). You authorize us to charge your designated payment method for these recurring fees.
• Prices for our services may change at any time. We will provide you with reasonable notice of any change in fees before they become effective. Your continued use of BuzzFlix after the fee change comes into effect constitutes your agreement to pay the modified fee amount.
• You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the paid features until the end of your current billing period. We do not provide refunds or credits for partial subscription periods or unused services.
• If we are unable to process payment through your designated payment method, we reserve the right to suspend or terminate your access to paid features until payment is successfully processed.

7. Termination

• We reserve the right to terminate or suspend your account and access to BuzzFlix, at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
• Upon termination, your right to use BuzzFlix will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us for account deletion.
• All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8. Limitation of Liability

To the fullest extent permitted by applicable law, BuzzFlix and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of BuzzFlix after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, you must stop using the service.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of BuzzFlix shall be brought exclusively in the state or federal courts located in France, and you hereby consent to the personal jurisdiction and venue of such courts.
